TECMES INSTRUMENTOS ESPECIALES S.R.L. (hereinafter “TECMES”) is a limited liability company incorporated in the Autonomous City of Buenos Aires, with the purpose of developing, manufacturing, and marketing high-precision meteorological equipment and providing useful and processed environmental information produced by said equipment for historical, hydrological, and meteorological data collection and agronomic decision-making.

These terms and conditions of use (hereinafter, the “Terms and Conditions”) govern the use of the products, content, and services provided on the website www.tecmes.com (hereinafter, the “Site”) and made available by TECMES to its customers (hereinafter, the “Customers”).

You may use this Site and the Pegasus Mobile and Tecmes Mobile apps provided that you accept and comply with these Terms and Conditions. Therefore, by accessing and using them, you accept them in their entirety and agree to comply with them.

At TECMES, we value your privacy and inform you that we do not collect, store, or share any personal information or usage data from our users.

TECMES reserves the right to update, modify, or revoke these Terms and Conditions at any time, for any reason, and without prior notice, and assumes no liability for any consequences resulting from such changes. Changes will be posted on the Site and will become effective upon publication. Violations of these Terms and Conditions will result in the termination of registered Customer status for violators.

The service provided by TECMES consists of providing the Client with easily interpretable numerical, graphical, and historical information on direct and processed variables of environmental data obtained from Pegasus and Meteortec weather stations and/or other equipment marketed by TECMES (hereinafter, the “Service”).

TECMES and the Client are responsible for ensuring that the Service is used in accordance with applicable law and in accordance with the Terms and Conditions.

The Client must register in their own name and must inform TECMES as soon as possible of any changes to the information provided during registration. Registration may require the Client to identify themselves with the username and password provided by TECMES.

The Service is subject to the fees agreed upon between TECMES and the Client, which may be updated periodically by TECMES. Any delay in the agreed fees for more than ten (10) business days from the payment date entitles TECMES to interrupt and/or cancel the Service.

You hereby agree to grant TECMES the royalty-free, worldwide, perpetual, irrevocable, and non-exclusive right and license to use, reproduce, publicly display or perform, distribute, modify, adapt, publish, translate, edit, transmit, modify, and sublicense the data provided by the Pegasus/Meteortec weather station owned by you and to create derivative works thereof (in whole or in part, directly or indirectly), and to incorporate them into other works in any form, manner, media, or technology now known or later developed. TECMES may also use the data provided by the weather stations to develop and market new products and/or services that utilize such information and/or data, without restriction and without compensation to you.

The Client has a personal, non-exclusive, and non-transferable license to the Service, graphics, and data compiled and produced by TECMES, which are provided for its personal use.

TECMES provides the Service “as is” and “as available,” without warranties of any kind. TECMES does not warrant or guarantee the availability of this Site at any particular time or location, nor that its operation will be uninterrupted or unfailing.

TECMES is not obligated to provide any equipment or software to access the Service. The Client must have all necessary resources, including telecommunications resources, to do so.

You use this Site at your own risk. The information provided on this Site is merely intended to allow the Client access to a large amount of environmental data from its facility, compiled and processed for more informed hydro-meteorological and agronomic decision-making. Under no circumstances will TECMES be liable for any direct or indirect damages or losses resulting from or related to the use of this Site, the inability to use it, or your reliance on any information provided herein. This global limitation includes all damages of any kind, whether direct or indirect, general, special, incidental, consequential, exemplary, or otherwise, including loss of data, income, or profits. This limitation of liability also applies whether the claimed liability is based on contract, tort, strict liability, negligence, or negligence, or arising from any other cause. If any part of this limitation of liability is found to be invalid or unenforceable, TECMES’s total liability in such circumstances, for liabilities that would otherwise have been limited, shall not exceed one thousand pesos ($50,000).

Any delay or failure by TECMES to enforce these Terms and Conditions shall not be construed as a waiver of its rights.

The Client’s subscription to the Service is valid for one (1) year from the start date and is automatically renewable.

Notice to the Client may be sent by email to the address provided upon registration.

Notice from the Client to TECMES may be sent by email to tecmes@tecmes.com, or by mail or courier to the following address: Av. Belgrano 1378/80, Autonomous City of Buenos Aires, Argentina.

Jurisdiction and Applicable Law: Any dispute between the Client and TECMES shall be governed by the laws of the Argentine Republic. Any dispute shall be submitted to the Ordinary Commercial Courts of the Federal Capital.
